PACDL's Response to proposed changes to Pa.R.Crim.P. 119 & 500
The U.S.A.G. has instructed all federal prosecutors to change course and now apply the Fair Sentencing Act of 2010 to all cases where a defendant was sentenced after August 3, 2010. The new crack mandatories and the new guidelines apply to all cases that had not reached sentencing by 8/3/10 and this will create a basis for some defendants to seek habeas relief under 28 U.S.C. Section 2255 to correct and modify their sentences. Click here for the memo
