INCREASING THE ODDS IN YOUR FAVOR WHEN DEFENDING A GAMBLING ADDICT
The rapid expansion of legalized gambling has all but ignored a growing but hidden consequence: gambling disorder. Most people gamble for recreation only, but a proportion will develop an addiction to gambling so severe they will experience bankruptcy, homelessness, job loss, and family disruption. Similar to substance-based addictions, problem gamblers suffer symptoms of tolerance and withdrawal and often commit crimes to fuel continued play. However, many people still view excessive gambling as a “vice” not an addiction and may be reluctant to believe that a behavior can evoke changes in the brain analogous to a substance. Problem gamblers can conceal the extent their addictions until the damage is irreparable and the consequences, severe. Expert testimony can be critical to a criminal defense strategy to explain this complicated and confusing behavior. This webinar will discuss the hallmarks of gambling addiction, the impact of the conduct on behavior, and ways an expert can inform the Court or jury that this behavior is not the result of irresponsible individuals. It will also focus on how to determine the qualifications of a gambling expert, effectively use expert testimony in sentencing presentations, and successfully communicate the expert’s detailed report.
