Behind Bartkus: A Flamboyant Lawyer, a Vindictive Judge, and the Untold Story of Double Jeopardy's Dual Sovereignty
Acquitted after three hours of deliberation by a federal jury in a routine bank robbery case, Alfonse Bartkus was tried again for the same crime. This time by an Illinois state jury with an opposite result. Bartkus was found guilty and given a life sentence. On appeal, the United States Supreme Court held that the State of Illinois was a different government than the United States and so each could prosecute. In 2019, the proposition was upheld in Gamble v. United States. This session will uncover the details of the Bartkus case and what that means for criminal defense counsel.
