How do courts really decide whether withheld evidence is material under Brady?

Join nationally recognized criminal procedure scholar Adam Gershowitz as he uncovers what’s actually happening in Brady rulings across the country. Drawing from a unique, multi-year database of state and federal court decisions, Professor Gershowitz exposes troubling patterns in how courts reject Brady claims—even when the withheld evidence favors the defense. Learn why impeachment evidence often gets sidelined, how courts misapply the materiality standard, and what this means for your clients.

This compelling webinar will dive into his recent law review scholarship and preview a forthcoming article on failure to disclose cash payments to witnesses—and how courts often mishandle the resulting Brady claims.

Understanding how courts evaluate Brady materiality is essential if you are a criminal defense attorney. This webinar arms you with real data, sharp analysis, and practical strategies to push back against flawed reasoning. Walk away with the tools to better protect your clients’ constitutional rights—and to spot and argue Brady violations with greater confidence and impact.
